  • HRW urges the Court to confirm that a State Party to the American Convention on Human Rights violates the right to life established in article 4, considered in conjunction with the article 1, when to) does not carry out an effective investigation of an alleged illegal deprivation of life; y b) does not investigate discrimination against LGBT people as a possible motive as required by the obligation to investigate deprivations of the right to life of LGBT victims.

    Taking advantage of the opportunity in the case of Vicky Hernández and family vs.. Honduras to expand its jurisprudence on this important legal issue, including clarifying that failure to carry out an effective investigation constitutes a separate and independent violation of article 4, This Court would reinforce the obligation of the State to protect the right to life of LGBT people, particularly in a country like Honduras where practically all cases of violent crimes go unpunished.
